Workcover NSW is responsible for compliance relating to work health and safety legislation aimed at protecting the welfare of people engaged in work or employment. Whilst there are some schemes that may have exemptions, obtaining a safety audit report is the best method to utilise qualified persons to identify possible risks or hazards.

For the purposes of the Work Health & Safety Act 2011, the owners corporation acts as a person conducting a business or undertaking (PCBU), and thus having a primary duty to ensure the health and safety of workers while they are at work in the business or undertaking. This applies to others on common property, who may be affected by the carrying out of work, such as visitors.
